Chapter 49 of the Penal Code can be found here.  The structure of this Chapter of the Penal Code outlines the offenses and associated punishments prescribed by law. While this Chapter goes into great detail about the specifics of each prescribed punishment, it does not address or contemplate the possibility of enhancement for Habitual Offenders. Chapter 49 of the Texas Penal Code addresses such offenses as Public Intoxication, Possession of Alcoholic Beverage in Motor Vehicle, Driving While Intoxicated, Driving While Intoxicated with Child Passenger, Flying while Intoxicated, Boating While Intoxicated, Assembling or Operating an Amusement Ride while Intoxicated, Intoxication Assault and Intoxication Manslaughter. In addition to Chapter 49’s focus on Intoxication, it also addresses Enhanced Offenses & Penalties specific to Intoxication Offenses. For example, §49.09 of the Penal Code goes into detail about how a DWI Second is a Class A Misdemeanor as opposed to the First DWI. Additionally, §49.09 contemplates offense enhancements due to BAC (Blood Alcohol Content), injuries and/or death of Emergency Medical Services personnel, and how Third Driving While Intoxicated can potentially become Third Degree Felonies.
